These Terms of Service ("Terms") govern your access to and use of yesnohire (the "Service"), operated by Vadym Radionov ("yesnohire", "we", "us"). Contact: vadim.radionov@yesnohire.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms apply to you, the user — a recruiter, hiring manager, or hiring organization using yesnohire to assist with interviews. They do not apply to candidates you interview; candidates are covered by our separate Candidate Privacy Notice.
1. The Service
yesnohire is an AI-assisted tool for interviewers. It joins your online interviews via a recording assistant, transcribes them, and generates real-time and post-interview assessments of candidate competencies to help you evaluate candidates. The Service assists your decision-making; it does not make hiring decisions. All hiring decisions are made by you.
We may modify, improve, or discontinue features of the Service at any time. We will give reasonable notice of material changes where practicable.
2. Eligibility and accounts
- You must be at least 18 years old and legally able to enter into these Terms.
- You must use the Service in a professional context (recruiting/hiring), not as a consumer.
- You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.
- We may grant, limit, suspend, or revoke access to the Service at our discretion.
3. Your responsibilities and acceptable use
You are responsible for using the Service lawfully. In particular, you are responsible for the legal basis and notifications required to record and analyze your interviews, including informing candidates that the interview is recorded and analyzed, and complying with applicable recording, employment, and data protection laws in your and the candidate's jurisdictions.
You agree not to:
- use the Service to unlawfully discriminate against candidates or make hiring decisions in violation of anti-discrimination or employment law;
- upload content you have no right to upload, or that infringes others' rights;
- attempt to reverse-engineer, disrupt, overload, or circumvent the Service or its security;
- resell or provide the Service to third parties except as permitted;
- use the Service to build a competing product, or scrape or extract data at scale;
- misuse the AI outputs (see section 4).
You acknowledge that you are the party interacting with candidates and that you, not yesnohire, are responsible for how you use assessments in your hiring process.
Your use of the Service is also subject to AI-specific hiring regulations that may apply to you — see section 4A.
4. AI-generated assessments — nature and limitations
The assessments, scores, follow-up questions, and reports produced by the Service are generated by artificial intelligence and are provided as decision support only. They:
- may be inaccurate, incomplete, or biased;
- are not a determination of a candidate's suitability, and must not be the sole basis for a hiring decision;
- do not constitute professional, legal, or employment advice.
You are responsible for reviewing outputs critically and for ensuring your final decisions are lawful and fair, made by a human. We disclaim liability for hiring decisions you make based on or informed by the Service, to the maximum extent permitted by law.
Note on human review: while all final hiring decisions are made by you (a human), you acknowledge that under certain regulations (including the EU AI Act), the presence of human review does not by itself remove an AI hiring tool from the "high-risk" category or the associated compliance obligations described in section 4A.
4A. AI hiring regulation — allocation of responsibility
AI tools used to assess candidates are increasingly regulated. Two regimes are particularly relevant, and responsibility is shared between us (as the tool provider) and you (as the deployer using it in your hiring process). This section describes the allocation; it is not legal advice, and you are responsible for your own compliance.
EU AI Act. AI systems used for recruitment and candidate evaluation (including interview analysis) are classified as "high-risk" under the EU AI Act, and this classification is not removed merely because a human makes the final decision. The Act can apply even to non-EU parties where candidates or outputs are used in the EU. Core high-risk obligations for such systems currently apply from 2 December 2027 (as deferred by the Digital Omnibus), with certain AI-transparency duties applying earlier. As the provider, we work toward the provider-side obligations that apply to us (such as documentation, data governance, and transparency). As the deployer, you are responsible for deployer-side obligations, which may include human oversight, informing candidates and worker representatives, and record-keeping.
NYC Local Law 144 (and similar US laws). If you use the Service to assess a candidate who resides in New York City, that use may be an "automated employment decision tool" (AEDT) subject to Local Law 144, which requires an independent bias audit, publication of results, and advance notice to the candidate (generally at least 10 business days). These obligations fall on you as the employer/employment agency, not on us as the vendor; however, we will provide reasonable information to support an independent audit where feasible. Similar laws are emerging in other jurisdictions.
Your responsibility. You are responsible for determining which AI-hiring regulations apply to your use, in your and your candidates' jurisdictions, and for complying with them (including any bias audit, notice, and transparency duties). You must not use the Service in a way that would violate applicable anti-discrimination or AI-hiring law.
5. Credits, payments, and billing
The Service operates on a prepaid balance model.
5.1 Balance and usage. You add funds to your account balance ("credits"). Using certain features — in particular conducting interviews — consumes credits from your balance according to our then-current pricing (currently USD 0.16 per interview minute). If your balance is insufficient, those features may be unavailable until you top up.
5.2 Top-up. You may add funds to your balance in any amount at or above the minimum (currently USD 10). Top-ups are added to your existing balance.
5.3 Payment processing. Payments are processed by our payment provider, Creem (creem.io), which acts as Merchant of Record. This means the payment provider — not yesnohire — is the seller of record for the transaction, and is responsible for processing your payment, handling applicable taxes (including VAT), and issuing receipts. Your payment card details are handled by the provider; yesnohire does not receive or store your card details. Your purchase is also subject to the payment provider's terms.
5.4 Taxes. Prices may be shown excluding tax. Applicable taxes are calculated and collected by the Merchant of Record.
5.5 No refunds. All payments are final. Credits added to your balance are non-refundable, including unused credits, except where a refund is required by mandatory applicable law that cannot be excluded. Credits consumed for services already provided (such as interviews already conducted) are non-refundable in all cases. Because the Service is provided to you as a professional/business user, statutory consumer-withdrawal rights generally do not apply; where any mandatory refund right does apply, we will honor it only to the extent legally required.
5.6 Bonus credits. We may grant promotional or invite bonus credits. Bonus credits have no cash value, are non-refundable, and may expire or be subject to conditions.
5.7 Pricing changes. We may change pricing and the credit cost of features. Changes apply to future usage and top-ups, not to credits already purchased.
5.8 Chargebacks. Initiating a chargeback or payment dispute without first contacting us to resolve the issue is a breach of these Terms. We may suspend or terminate your account, and forfeit any remaining balance, in response to a chargeback we consider unwarranted or fraudulent, without limiting our other remedies.
6. Your content and data
6.1 Your content. You retain your rights to the content you provide (job descriptions, candidate résumés, and interview data you are authorized to process). You grant us a limited license to host, process, and analyze that content solely to provide the Service to you.
6.2 Data protection. Our handling of personal data is described in our Privacy Policy (for you, the user) and our Candidate Privacy Notice (for candidates). For personal data of candidates that we process on your behalf, we generally act as your data processor, and you act as data controller. To the extent the GDPR applies, the data-processing terms required under Article 28 GDPR — including the subject-matter and duration of the processing, its nature and purpose, the types of personal data and categories of data subjects, and our obligations as processor — are set out in these Terms together with our Privacy Policy and Candidate Privacy Notice, which together constitute the Data Processing Agreement (DPA) governing that processing. A standalone DPA is available on request.
6.3 Your obligations as controller. You represent that you have a lawful basis to collect and process candidate data through the Service, and to have it recorded and analyzed, and that you have provided candidates the required information.
7. Intellectual property
The Service, including its software, models integration, design system, and content (excluding your content), is owned by yesnohire or its licensors and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service. You may not copy, modify, or create derivative works of the Service except as permitted.
8. Third-party services
The Service relies on third-party providers (for example, meeting-recording/transcription, AI model, hosting, and payment providers). The key providers are listed in our Privacy Policy. Your use may be subject to their terms, and we are not responsible for their acts or omissions.
9. Confidentiality and security
We apply reasonable technical and organizational measures to protect your data, including access controls isolating each account's data. However, no system is perfectly secure, and we cannot guarantee absolute security.
10. Suspension and termination
- You may stop using the Service and delete your account at any time. Deleting your account permanently deletes your account data as described in the Privacy Policy.
- We may suspend or terminate your access if you breach these Terms, use the Service unlawfully, or for fraud/abuse, with notice where practicable.
- On termination, your right to use the Service ends. Any unused credits are forfeited and non-refundable on termination or account closure, except where a refund is required by mandatory applicable law (see section 5.5).
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of AI outputs, or uninterrupted availability, to the maximum extent permitted by law.
12. Limitation of liability
To the maximum extent permitted by law, yesnohire will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, hiring outcomes, or decisions made using the Service. Our total aggregate liability arising out of or relating to the Service will not exceed the total amount you paid to us in the three (3) months immediately before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnification
You agree to indemnify and hold harmless yesnohire from claims, damages, and costs (including reasonable legal fees) arising out of your use of the Service, your content, your hiring decisions, or your breach of these Terms or of applicable law (including data protection, anti-discrimination, and AI-hiring law).
14. Changes to these Terms
We may update these Terms. We will post the updated version with a new "last updated" date and, for material changes, provide reasonable notice. Continued use after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the operator of yesnohire is established, without regard to conflict-of-laws rules. The courts of that jurisdiction will have exclusive jurisdiction over disputes, unless mandatory local law of your own jurisdiction provides otherwise.
